Regular Branch meetings are held at various locations in the
North-East of England. These are open to everyone and a wide
variety of topics are presented and discussed in a friendly
informal atmosphere. The Branch also organises seminars and
demonstration arbitrations for its members and for other interested
or involved in arbitration.

On 19th May the joint North East and North West Branch Dinner was
held at Cedar Court Hotel in Huddersfiled. The speaker was Martin Burns, Director of Dispute Reslotion
services, RICS.
Arbitration Case Law Update: Creating a 'Big-Bang' -
September 2008
On 10th September 2008, the world’s scientific community
gathered to witness various matter that was sent on a collision
course to re-create the ‘big bang’. Meanwhile on
the same day at the Leeds Metropolitan University, 40 delegates
from the CIArb North East branch gathered to hear Peter Collie,
a barrister from No 5 Chambers in Birmingham, explain how arbitral
parties had sent various matter on a collision course in an
Arbitration Case Law update, which created its own ‘big
bang’ in 2007. Peter explained how 2007 was a ‘vintage
year’ for arbitration with cases dealing with bribery,
the entitlement to a fair and public hearing, invalid appointments,
a taint of bias, the adequacy of reasons, alleged irregularity
if a party fails to take a point, procedural irregularity and
substantial injustice through the use of the tribunal’s
expertise.
Liquidated Damages: Exploding the Myths
On 14th October 2008, Dr Hamish Lal, a Partner from the London
office of Dundas & Wilson LLP, exploded some of the myths
concerning the operation of liquidated damages. In a thought
provoking presentation that he made to the CIArb North East
Branch in Leeds, Hamish dealt with three principle issues. First
the test as to whether liquidated damages can be construed as
a penalty or are compensatory and if compensatory, is this a
myth created by public policy. Second, whether liquidated damages
can be avoided because the contractual mechanism does not apply.
Alternatively, can the event that gives rise to the application
of liquidated damages simply be a trigger event that is a term
of an underlying contract. Finally, whether it is a myth that
the exclusive remedy that liquidated damages purport to provide
in the event of a delay, can always apply to breaches of contract
in which damages may also arise as a consequence of a party’s
failure to proceed regularly and diligently. The full text of

A Construction Law Update
On 2nd December 2008, Jonathan Selby, a Barrister from Keating Chambers, gave an insight into
a range of cases in the form of a Construction Law Update to the North East Branch in Leeds. The
topics discussed included non-payment as a repudiatory breach, which the Court of Appeal considered
in Alan Auld v Rick Pollard [2008] BLR 419. Guidance on the giving of opinion evidence by non-expert
witnesses, derived from the long running saga over Wembley between Multiplex and Cleveland Bridge.
A contrast in the dominant cause approach to ‘extensions of time’ endorsed in Steria v Sygma [2008]
BLR 79 and reviewed in City Inn v Shepherd [2008] BLR 269. A pragmatic approach to compliance with
the Pre-Action Protocol in Orange v Hoare Lee [2008] EWHC 223(TCC); whether the supervisory role of
the Architect over the employees of others constitutes vicarious liability in Biffa Waste [2008] EWCA
Civ 1257 and cases concerning interest referred to in Leriche v Maurice [2008] UKPC 8 and Sempra Metals
